Implementing a Business Development Incentive electricity tariff for UNELCO in Efate

The Utilities Regulatory Authority (URA) Commission is pleased to issue this Final Decision and Order implementing a Business Development Incentive electricity tariff for UNELCO in Efate (case U-0013-14). Pursuant to its Preliminary Decision in July 2014, Commission staff held public consultations and received valuable comments from several interested persons. Many of the suggestions have been incorporated int this Order.

VUI Limited's electricity tariffs

The Utilities Regulatory Authority (URA) Commission is pleased to issue this Final Decision and Order in the matter of the request from the Vanuatu Utilities Infrastructure (VUI) for a tariff adjustment for electricity services in Luganville (case U-0001-15).

Electricity Tariff Review

The Government’s concern about the high cost of electricity has led to the Authority undertaking a full review of the level and structure of tariffs for all concession areas. Under Section 2 paragraph 27 of the Luganville concession agreement and under Section 7.5 of the Port Vila concession agreement, and at the request of the Government, the electricity tariff was reviewed as more than five years had lapsed since the previous review. This tariff review also provided guidance to the Government for negotiating the level and structure of consumer tariffs and formulating a different process for tariff-setting for the expiring (end 2010) concession in Luganville. In May 2010, the Authority completed its tariff review and recommended a 6.8% reduction of the electricity tariff, which is applied in Luganville. The decision was disputed for the three other concessions and a panel of arbitration was set up to find a compromise. In May 2011, the tariff was reduced by 4.7% on average for the, Port Vila, Malekula and Tanna concessions. This was the first ever electricity price reduction and a great achievement to the benefit of all electricity customers in Vanuatu.  In addition, the Authority has put in place a transparent regulatory framework structure for tariff setting and it will review the price of electricity every five years.

Pricing

 Section 18 of the Utilities Regulatory Authority Act No 11 of 2007 empowers the URA to determine the maximum price that may be charged in relation to any aspect of a regulated service.

The URA must take into consideration the price of similar services in comparable locations when determining prices.

The URA also aims to find the right balance between the interests of consumers of Vanuatu, the regulated utilities and the Government. Tariff reviews assess the continuing appropriateness of tariffs in terms of their level and structure.

Consumers should not pay more than necessary for electricity services of a given standard.

Utilities should be able to charge tariffs in such a manner that allows it to cover all its costs, which includes operating, maintenance and investment costs.

The Government of Vanuatu should be able to meet its need for long term growth and economic development, and tariff should support improvements and future investments in electricity supply.

The price in Port Vila and on Malekula and Tanna islands is based on the URA’s tariff review that came out in 2011. The utility uses a formula adjusting prices, which means that the base tariff changes each month.

The concession in Luganville has a slightly different tariff given that the utility currently operates under a Memorandum of Understanding signed by the Government in November 2010. This concession is directly subjected to the URA's decisions, unlike the other concession contracts, which were signed before the regulator's office was established.
